Personal Data Collected Through Your Use of the Site and Services

We collect certain types of information and data, as described below, through your use of the Site and in connection with our provision of Services. Depending on how you interact with our Site and Services, we will collect the following Personal Data that you voluntarily provide to us for the following purposes:

  • Create and Log Into an Account. If you sign up for a RevOptimal account (“Registered Account”), you will provide us with your email address, name, company name, and you will create a password for your Registered Account. You may also choose to provide us with other information, such as your phone number and job title.
  • Use Our Services. If you use our software and platforms, you may provide us applicable information, including your name, company contact information and other pertinent information pertinent to use of our Services.
  • Contact Us. If you submit a form to contact us, you will provide us with your name and email address. In contacting us, you may also choose to provide further information, such as your phone number, organization’s name and other details pertinent to your business.
  • Feedback: We may request that you provide us certain feedback regarding our Site or our Services, including ratings, reviews and references.
  • Subscribe to Email. If you subscribe to receive emails from us, you will provide us with your first name and email address. To unsubscribe from our marketing emails, please click the unsubscribe link included in the footer of our emails.
  • Careers. If you apply for a job with us, you will provide us with your name, email address, phone number, street address, and any information you choose to provide in your resume and cover letter.
Information Collected in Connection with Our Services

We automatically collect certain information and data through your use of our Site and our use of cookies and other tracking technologies (“Usage Data”). Usage Data is primarily needed to maintain the security and operation of the Site, and for our internal analytics and reporting. Examples of Usage Data we collect and use, include:

  • Portions of the Site you access, frequency of your access, and what you click on while on the Site; and
  • If it can be reasonably linked to your use of the Site or Services, your IP address, MAC address, device type, unique device identifiers, mobile network information, advertising identifiers, operating system information, browser type, location, user preferences, and browsing activity and history.

Information Collected Automatically as You Navigate Our Site

In order to provide Services to our customers, we collect and use information from the other sources that include:

  • third-party vendors who license data to us;
  • marketing service providers; and
  • publicly available sources, such as the National Provider Registry (NPI) and states' election divisions or secretaries of state.

The data we obtain from these other sources contains Personal Data that we use to provide quality information to our customers. The information we collect from these other sources includes, for example:

  • name, personal and professional contact information, employment details and other details about individuals such as gender, age, marital status, homeownership, and income;
  • television viewership data, such as the programs audiences watch and the devices on which they watch those programs;
  • individuals’ interests such as travel interests, purchasing interests, and other preferences;
  • elections information, such as party registration (in states where available), and what elections individuals voted in (including general elections and primary elections); and
  • data about predicted views on issues and purchases. We use either our own surveys or survey data from third parties to make predictions about how likely individuals are to take an action, such as support a candidate or cause.

How We Share Personal Data

Our sharing of your Personal Data depends on the way in which we collect that Personal Data. If you are using our Site or Services, we may disclose, share or transfer the Personal Data that we collect about you for the following purposes:

  • Compliance with Laws and Proceedings. Where we are legally required to do so in order to comply with applicable law, governmental request, judicial proceeding, court order, legal process or as evidence in litigation in which we are involved.
  • Legal Rights. Where we believe it is necessary to defend, exercise or otherwise take action regarding our or any third party’s legal rights, including assertion of our intellectual property rights.
  • Vital Interests. Where we believe it necessary to monitor, investigate, prevent or otherwise take action related to suspected or actual violations of this Privacy Policy, our other policies, fraud, threats to the safety of any person, illegal activities, or as evidence in litigation in which we are involved.
  • Vendors, Consultants and Other Third Parties. With third party vendors, service providers, contractors or agents who perform services on our behalf or who are our business partners for purposes of advertising (e.g. for data analysis, email delivery, hosting services, customer service and marketing efforts). This includes allowing selected third parties to use tracking technologies on our Site and in connection with our Services and, if applicable, to serve ads on our Site and to otherwise promote products and services to you.
  • Corporate Events. In connection with or in anticipation of any merger, sale of company assets, financing, acquisition of all or a portion of our business, bankruptcy, liquidation or other similar transaction or proceeding related to our business.
  • With your Consent. For any other purpose with your consent.
  • Business Interests. To provide Services to our customers or otherwise fulfill our legal obligations to others and for any other purpose that we disclose to you or that we deem compatible with the original purpose of collection.

Security and Safety

Our Practices

We maintain commercially reasonable security measures to protect the Personal Data we collect and store from loss, misuse, destruction and unauthorized access. However, we cannot guarantee absolute security because no security measure or modality of data transmission over the internet is 100% secure. You should only access the Services within a secure environment. Transmission of Personal Data to and from our Site and/or our Services is at your own risk.

Retention of Personal Data

We will only keep your Personal Data for as long as necessary for the purposes set out in this Privacy Policy, unless a longer retention period is required or permitted by law. Once we no longer have an ongoing, legitimate business interest in storing, using or otherwise processing your Personal Data, or where you have requested to opt out of use of your Personal Data, we will either delete or anonymize it. If deletion or anonymization is not possible, such as when your Personal Data has been stored in our backup archives, we will securely store your Personal Data and isolate it from any further usage or processing until deletion is possible.

Third-Party Links

The Services may link to other websites and internet resources, or incorporate third-party tools, services, APIs, SDKs, and widgets that are not owned, operated or controlled by us. Any data collected or used by third parties is not covered by this Privacy Policy. We are not responsible for the content or privacy and security practices and policies of any third parties, including other websites, services or applications that may be linked to or from our Site. You should review the policies of such third parties and contact them directly to respond to your questions.

Children's Privacy

The Site and Services are not intended for use by anyone under age 18. We do not knowingly collect data from or market to children under age 18. By using the Site and/or our Services, you represent that you are at least 18. If we learn that Personal Data from users less than 18 years of age has been collected by us, we will take reasonable measures to promptly delete such data from our records. Your State Privacy Rights

Depending on the state in which you reside, you may have certain privacy rights regarding your Personal Data. If you are a California resident, please see our “Notice to California Residents” section below. For other state residents your privacy rights may include:

  • Right to confirm whether or not we are processing your Personal Data and to access such the content or categories of Personal Data we are processing or have processed.
  • Right to obtain a copy of your Personal Data that we collected from and/or about you in a portable and, to the extent technically feasible, readily usable format that allows you to transmit the information to another controller without hindrance, where the processing is carried out by automated means.
  • Right to obtain a list of categories of third parties to which we have disclosed your Personal Data.
  • Right to obtain a list of specific third parties, at our option, to which we have disclosed your Personal Data, other than disclosures we may have made to any natural persons.
  • Right to delete Personal Data that we collected from and/or about you, subject to certain exceptions.
  • Right to correct inaccurate Personal Data that we maintain about you, subject to certain exceptions.
  • Right to opt out of the processing of your Personal Data for purposes of targeted advertising or the “sale” of your Personal Data (as that term is defined by applicable law), if applicable.
  • Right to withdraw your consent if and as we are required by applicable law to obtain your consent to process sensitive Personal Data about you.
  • Right not to receive discriminatory treatment by us for the exercise of your privacy rights.

Under limited circumstances we sell the following categories of Personal Data to our customers or business partners with whom we have a legal binding contract that includes data protection and privacy provisions:

  • certain demographics and contact information; and
  • inferences as to consumer demographics and consumer views on various issues and purchases and preferences.

In addition, depending on how the applicable privacy law defines a “sale,” our Site's use of cookies and tracking technologies may constitute a sale of Personal Data (i.e., information from cookies) to third-party advertisers and analytics companies. Our Site also uses cookies and other tracking technologies to display advertisements about our products to you on nonaffiliated websites, applications, and online services. This is “targeted advertising” under applicable privacy laws. We do not use Personal Data for profiling in furtherance of “decisions that produce legal or similarly significant effects” concerning individuals.

To exercise your rights, please submit a request using the form found at www.revoptimal.com/dsar. In your request, please state the information you want changed, whether you'd like the information suppressed from our database, and/or whether there are limitations you'd like us to put on how we use your Personal Data. If legally required by us, or as we otherwise deem feasible and appropriate, we will comply with your request.

Any request you submit to us, in order to be satisfied, will include verification of your identity and, to the extent applicable, the identity of the individual on whose behalf you are making such request. For such verification purposes, we may ask you to verify data points based on information we have in our records. If you are submitting a request on behalf of another individual, please use the same contact methods described above. We might need to keep certain information for recordkeeping purposes, as allowed by law, so in certain circumstances your request won't ensure complete removal of the information from our database.

Privacy Policy Updates

We may update this Privacy Policy from time to time for various reasons, including as necessary to stay compliant with relevant laws. The updated version will be indicated by a “Last Updated” date and the updated version will be effective as soon as it is accessible.

If we make material changes to this Privacy Policy, we may notify you either by prominently posting a notice of such changes or by directly sending you a notification. We encourage you to review this Privacy Policy frequently to be informed of how we are protecting your information.

Notice to California Residents

The California Consumer Privacy Act, as amended by the California Privacy Rights Act of 2020 (“CCPA”) requires that we provide California residents with a privacy policy that contains a comprehensive description of our online and offline practices regarding the collection, use, disclosure, sale, sharing, and retention of personal information and California residents' of rights in their personal information.

If you are not a California resident, this section does not apply to you and you should not rely on it.

The CCPA defines “personal information” to mean information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular California resident or household. Personal information does not include publicly available, deidentified or aggregated information or lawfully obtained, truthful information that is a matter of public concern.   • helping to ensure security and integrity of our Site and Services to the extent the use of your Personal Information is reasonably necessary and proportionate for these purposes
  • short-term, transient use;
  • performing Services, including maintaining or servicing accounts, providing customer service, processing or fulfilling orders and transactions, verifying customer information, providing analytic services, and providing advertising and marketing services;
  • undertaking internal research for technological development and demonstration activities to verify or maintain the quality of our products and Services, and to improve, upgrade, or enhance our products and Services; and

Right to Know, Delete and/or Correct Personal Information

If you submit a request to delete online, you may be asked to confirm separately that you want your Personal Information deleted. If you are submitting a request on behalf of a California resident, please submit the request through one of the designated methods discussed above. After submitting the request, we will require additional information to verify your authority to act on behalf of the California resident.

Our Process for Verifying a Request to Know, Delete, and/or Correct: We will comply with your request upon verification of your identity and, to the extent applicable, the identity of the California resident on whose behalf you are making such request. We will verify your identity either to a “reasonable degree of certainty” or a “reasonably high degree of certainty” depending on the sensitivity of the Personal Information and the risk of harm to you by unauthorized disclosure, deletion, or correction as applicable. To do so, we will ask you to verify data points based on information we have in our records concerning you.

Right to Opt Out of “Sale” of Personal Information

You have the right to opt-out of the “sale” of their personal information. California law broadly defines what constitutes a “sale” - including in the definition making available a wide variety of information in exchange for “valuable consideration.”

If you would like to opt out, please submit a request using the form found at www.revoptimal.com/dsar to remove all information from our files, and have your information placed on a “suppression” list. We will only retain enough to ensure your information is not reintroduced.

Right to Limit Use and Disclosure of Sensitive Personal Information

California residents have the right to limit our use and disclosure of sensitive Personal Information for purposes other than those allowed by the CCPA and its regulations. You may submit a request to limit our use and disclosure of your sensitive Personal Information through the form found at www.revoptimal.com/dsar.

Right to Nondiscrimination

We will not deny, charge different prices for, or provide a different level of quality of goods or services if you choose to exercise these rights.

Information about persons under the age of 18.

We do not knowingly collect personal information from minors under 18 years of age in California unless we have received legal consent to do so. If we learn that personal information from such California residents has been collected, we will take reasonable steps to remove their information from our database (or to obtain legally required consent).

Authorized agents

You may also designate an agent to make requests to exercise your rights under CCPA as described above. We will take steps both to verify the identity of the person seeking to exercise their rights as listed above, and to verify that your agent has been authorized to make a request on your behalf through providing us with a signed written authorization or a copy of a legally sufficient power of attorney. We likewise may require that you verify your own identity, depending on the type of request you make.
